What the FZJ Software Guidelines say about Distribution and Open Source
Class 2 and higher
For the distribution of software, the approval processes of Forschungszentrum Jülich/the institute must be observed.
Example 1: It has been decided to make the software available on an open source basis. The respective institute head or a person authorized by the institute head must approve the publication.
Example 2: It has been decided to distribute the software to third parties on a restricted basis. The institute must consult with UE-I. UE-I then draws up an individual software licensing agreement together with the institute that regulates the use of the software.
Before distributing the data to third parties outside Forschungszentrum Jülich, it must be ensured that the regulations on export control (foreign trade law) have been observed.
Example: Before publication, the institute uses the EU dual-use list to check whether the software is listed. If there are any indications of this, Law and Patents must be involved. For example, software is listed under 3D001 if it is specially designed for developing or manufacturing equipment used for the fabrication of semiconductor devices or materials.
